Welcome to Revivo, operated by Be Captain Studio. By downloading, installing, or using our application, you agree to be bound by these Terms of Use. If you do not agree, please do not use the app.

1. Service Description

Revivo is an AI-powered photo restoration application that allows users to restore, enhance, colorize, and upscale old or damaged photographs. The service uses artificial intelligence models to process images and is provided on an "as-is" basis.

2. Account & Authentication

You may use Revivo with an anonymous account, Google sign-in, or Apple sign-in. You are responsible for maintaining the security of your authentication credentials. We are not responsible for any loss arising from unauthorized use of your account.

3. Credits & Free Tier

Revivo operates on a credit-based system:

Free users: Receive 1 free restoration per week, which resets every 7 days. Free restorations include a watermark on the output.
Pro subscribers: Receive 30 restorations per month with no watermark, HD resolution, and priority processing.
Credit packs: Additional credits can be purchased as one-time, non-expiring packs.

Credits used on failed restorations are automatically refunded to your balance.

4. Subscriptions & Payments

Subscriptions are billed through the Apple App Store or Google Play Store. By subscribing, you agree to their respective terms:

Payment is charged to your App Store or Play Store account at confirmation of purchase
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
You can manage and cancel your subscription in your device's account settings
Free trial periods, if offered, automatically convert to paid subscriptions unless canceled before the trial ends
Refunds are handled by the respective app store according to their refund policies
Prices may vary by region and are displayed in your local currency at the time of purchase

5. User Content & Photos

You retain all ownership rights to the photos you upload to Revivo. By uploading a photo, you grant us a limited, non-exclusive license to process the image solely for the purpose of providing the restoration service.

You represent and warrant that:

You have the right to upload any photo you submit
The photo does not violate any third party's intellectual property or privacy rights
The photo does not contain illegal, harmful, or offensive content

We do not claim ownership of your photos and do not use them for AI training, advertising, or any purpose beyond providing the restoration service.

6. Prohibited Use

You agree not to:

Upload content that is illegal, harmful, or violates others' rights
Attempt to reverse-engineer, decompile, or extract the AI models or source code
Use automated systems, bots, or scrapers to access the service
Resell or commercially redistribute restored images as a competing service
Circumvent credit limits, rate limiting, or other usage restrictions
Impersonate another person or misrepresent your identity
Interfere with or disrupt the service or servers

7. AI Processing Disclaimer

Our AI restoration is automated and results may vary. We do not guarantee:

Specific quality outcomes for any photo
That AI-generated colors in colorization match the original colors
That face restoration will produce an exact likeness of the original subjects
Continuous, uninterrupted, or error-free availability of the service
Compatibility with all image formats, sizes, or conditions

Revivo is a tool to assist with photo restoration, not a replacement for professional restoration services. Always keep backup copies of your original photos.

8. Intellectual Property

The Revivo app, including its design, code, AI pipeline, branding, animations, and all associated materials, is the intellectual property of Be Captain Studio and is protected by applicable copyright and trademark laws. You may not copy, modify, distribute, or create derivative works from any part of the app without our written consent.

9. Limitation of Liability

To the maximum extent permitted by law, Be Captain Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, goodwill, or other intangible losses, arising from:

Your use or inability to use the service
Any unauthorized access to or alteration of your data
Any third-party conduct on the service
AI processing results that do not meet your expectations

Our total liability for any claim related to the service shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Be Captain Studio from any claims, damages, losses, or expenses (including legal fees) arising from your use of the service, your violation of these terms, or your violation of any rights of a third party.

11. Termination

We reserve the right to suspend or terminate your access to Revivo at any time, with or without notice, for violation of these terms or for any conduct that we determine to be harmful to the service or other users. You may delete your account at any time through the app's settings, which will permanently remove your data within 30 days.

12. Changes to Terms

We may update these Terms of Use from time to time. We will notify you of material changes by posting the updated terms in the app. Continued use of the app after changes constitutes acceptance of the updated terms. If you do not agree with the changes, you must stop using the app.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of the Federative Republic of Brazil. Any disputes arising from these terms shall be submitted to the courts of Uberl\u00e2ndia, Minas Gerais, Brazil.

14. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
